Title 34, Part 6

The Texas Municipal Retirement System (TMRS) proposes to review and consider for readoption, revision, or repeal the chapter listed below, in its entirety, contained in Title 34, Part 6, of the Texas Administrative Code:

Chapter 121 Practice And Procedure Regarding Claims.

This review is conducted in accordance with Texas Government Code §2001.039. An assessment will be made as to whether the reasons for adopting or readopting the chapter continues to exist. Each rule will be reviewed to determine whether it is obsolete, whether the rule reflects current legal and policy considerations, and whether the rule reflects current procedures of TMRS.

Texas Health and Human Services Commission

Title 1, Part 15

The Texas Health and Human Services Commission (HHSC) adopts the review of the chapter below in Title 1, Part 15, of the Texas Administrative Code (TAC):

Chapter 360, Medicaid Buy-In Program

Notice of the review of this chapter was published in the July 26, 2024, issue of the Texas Register (49 TexReg 5549). HHSC received no comments concerning this chapter.

HHSC has reviewed Chapter 360 in accordance with Texas Government Code §2001.039, which requires state agencies to assess, every four years, whether the initial reasons for adopting a rule continue to exist.

The agency determined that the original reasons for adopting all rules in the chapter continue to exist and readopts Chapter 360. Any amendments, if applicable, to Chapter 360 identified by HHSC in the rule review will be proposed in a future issue of the Texas Register.

This concludes HHSC's review of 1 TAC Chapter 360 as required by Texas Government Code §2001.039.

Texas Department of Insurance, Division of Workers' Compensation

Title 28, Part 2

The Texas Department of Insurance, Division of Workers' Compensation (DWC) completed its review of 28 Texas Administrative Code Chapters 126 - 128. DWC conducted the review under Texas Government Code §2001.039.

Notice of the review was published in the August 16, 2024, issue of the Texas Register (49 TexReg 6285). There were no requests for a public hearing.

DWC received two comments by the September 16, 2024, deadline. No comments suggested repealing a rule in its entirety. Commenters for readoption and for readoption with changes were: Dr. James Baker and Dr. Jason Holmes. There were no commenters against readoption.

As a result of the review, and in accordance with Texas Government Code §2001.039, DWC finds that the reasons for initially adopting the rules continue to exist and readopts all sections in 28 Texas Administrative Code:

-Chapter 126 (General Provisions Applicable to All Benefits);

-Chapter 127 (Designated Doctor Procedures and Requirements); and

-Chapter 128 (Benefits--Calculation of Average Weekly Wage).

DWC may consider any suggested repeals or amendments identified during this rule review in future rulemaking under Texas Government Code Chapter 2001 (Administrative Procedure).

This concludes the review of 28 Texas Administrative Code Chapters 126 - 128.
